Proposed MSW Site Conformance Review
 

    

By State regulations and its contract with the Texas Commission on Environmental Quality, Texoma Council of Governments is obligated to review permit and registration applications for municipal solid waste management facilities to be located within TCOG's planning region for conformance with the adopted regional solid waste management plan for the region.  Additionally, TCOG may perform preliminary review on projects while they are still in the planning stages.  This page provides access to the regulatory and contractual requirements for these conformance reviews, the TCEQ form to be completed by TCOG in making such a review, and information on current formal and preliminary reviews in process (including time lines).  

Members of the public are invited to comment on any of the reviews underway during the appropriate comment period.  Comments may be submitted by fax to 903/813-3539 or made online through using the form provided by clicking here.    All comments received become the property of TCOG, will be used in the overall review process, and will be available for reading at TCOG by the public.

Contract Between TCOG and TCEQ
"4.5  MSW Facility Permit Application Review.  The PERFORMING PARTY (sic. TCOG) shall, with input from the Solid Waste Advisory Committee (sic. NRAC), review permit and registration applications for municipal solid waste management facilities to be located within the PERFORMING PARTY'S planning region for conformance with the adopted regional solid waste management plan for that region.  The PERFORMING PARTY'S determination of conformance shall be provided to the FUNDING AGENCY (sic. Texas Natural Resource Conservation Commission) in a format to be provided by the FUNDING AGENCY, within the review period requested by the FUNDING AGENCY."

Health and Safety Code Chapter 363.066
"Sec. 363.066. Conformity With Regional or Local Solid Waste Management Plan. (a) On the adoption of a regional or local solid waste management plan by commission rule, public and private solid waste management activities and state regulatory activities must conform to that plan. (b) The commission may grant a variance from the adopted plan under procedures and criteria adopted by the commission."

Regulatory Requirements of 30 TAC 330
"30 TAC 330.568(e) Agency responsibilities. It shall be the responsibility of the regional planning commission to coordinate the implementation of regional policies and recommended actions in an approved regional plan and coordinate local planning efforts. It shall be the responsibility of affected local governments to implement the policies and recommended actions of adopted regional and local plans and to maintain policies and activities that do not conflict with provisions in current state, regional, and local solid waste management plans."
