D/FW Air-Related Suits Against TNRCC
 

    

The September edition of the TNRCC publication Natural Outlook Monthly Update discusses six suits that have been filed against that agency seeking modification of the purpose State Implementation Plan to achieve cleaner air in the D/FW non-attainment area.  As of September 5, 2000 the online edition of this publication is not yet available at the TNRCC site. Air Transport Association of America v. TNRCC 
In this suit the Association seeks to prevent the TNRCC from requiring emissions reductions from ground-support equipment at the four airports in the D/FW area.
Cemex USA and Texas Industries, Inc. v. TNRCC 
This case challenges the TNRCC's rule requiring reductions in NOx emissions from cement kilns in the eastern and central portions of Texas.
Engine Manufacturers Association v. TNRCC 
The suit attacks the agency rule affecting ground-support equipment, as well as the accelerated purchase rule and the proposed ban on early morning construction.
TXU Electric v. TNRCC [two suits]
One case challenges the TNRCC's regional utility rule, which requires electric generating facilities to reduce NOx emissions by 50 percent across much of east Texas.
The other suit seeks to invalidate the Dallas-Fort Worth utility rule, which would require NOx reductions from electric utility boilers in the four county non-attainment area (a reduction of about 88 percent).
Solid Waste Association of North America, Allied waste Systems (Trinity Waste Services), BFI Waste Systems of North America, Inc., and the cities of Garland and Grand Prairie v. TNRCC
These plaintiffs seek to enjoin the TNRCC's accelerated purchase rule and early morning construction ban.
